California funds PaintCare through its paint stewardship law: a network of free drop-off sites, mostly paint retailers, that accept leftover architectural paint at up to 5 gallons per visit. For a contractor finishing a repaint with a few cans left over, that is the right answer and it costs nothing. Use it.
Two limits push commercial generators out of the program. If your business generates more than 27 gallons of hazardous waste per month, you may use PaintCare drop-offs for latex paint only, not for oil-based paint. And regardless of volume, sites do not accept aerosol coatings, solvents, leaking or unlabeled containers, or products labeled for industrial or non-architectural use. A 2023 California law brings aerosols into the program, but not until 2028.
What catches Sacramento businesses specifically is the county’s sequence. Sacramento County expects you permitted before waste moves, not after. Any Sacramento County business without a CUPA permit is expected to complete a Business Survey Questionnaire so the Environmental Management Department can determine which permit applies, and an EPA identification number comes from submitting DTSC Form 1358. A contractor who generates disposal-grade paint only a few times a year often has none of this in place when the need arises — and that is a slower problem to fix than booking a pickup.
Beyond the program limits, ordinary California rules apply: many paints are hazardous here regardless of federal classification, there is no equivalent of the federal very-small-quantity-generator exemption, and a Hazardous Materials Business Plan is required once you store above 55 gallons of liquid, 500 pounds of solid, or 200 cubic feet of compressed gas.

I only generate paint waste a few times a year. What do I need in place?
More than most occasional generators expect, and this is the Sacramento-specific catch. What about spray cans?
PaintCare sites do not accept aerosol coatings. A 2023 California law brings them into the program, but implementation runs to 2028, so for now aerosols are hazardous waste needing compliant collection.
We take them, but they must be declared — pressurized containers change how a load is packed and transported.
